Significa que, a partir de la fecha de aplicaci\u00f3n, los cosm\u00e9ticos que no cumplan la normativa no podr\u00e1n venderse en la UE.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7735d8a elementor-widget elementor-widget-heading\" data-id=\"7735d8a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfPor qu\u00e9 es necesaria la Omnibus Act VII?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a9cbab1 elementor-widget elementor-widget-text-editor\" data-id=\"a9cbab1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p id=\"ember201\" class=\"ember-view reader-content-blocks__paragraph\">El proyecto de medida es necesario para promulgar la prohibici\u00f3n de utilizar, como ingredientes cosm\u00e9ticos, sustancias clasificadas como carcin\u00f3genas, mut\u00e1genas o t\u00f3xicas para la reproducci\u00f3n (<strong>CMR<\/strong>) por el <strong>Reglamento (UE) n\u00ba 2024\/197 de la Comisi\u00f3n<\/strong>, que se ha adoptado sobre la base del Reglamento <strong>CLP<\/strong> y se aplicar\u00e1 a partir del 1 de septiembre de 2025. La modificaci\u00f3n del Reglamento sobre cosm\u00e9ticos es, por tanto, necesaria para transponer la nueva clasificaci\u00f3n de los CMR prevista en el <strong>Reglamento (UE) n\u00ba 2024\/197 de la Comisi\u00f3n<\/strong>.<\/p><p id=\"ember202\" class=\"ember-view reader-content-blocks__paragraph\">Esta vez, la industria no present\u00f3 ninguna solicitud para utilizar estas sustancias en productos cosm\u00e9ticos a modo de excepci\u00f3n, por lo que todas ellas quedar\u00e1n prohibidas.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bd51010 elementor-widget elementor-widget-heading\" data-id=\"bd51010\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfQu\u00e9 son las sustancias CMR seg\u00fan la Regulaci\u00f3n Cosm\u00e9tica de la UE?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d848aa3 elementor-widget elementor-widget-text-editor\" data-id=\"d848aa3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"0\" data-end=\"515\"><strong data-start=\"0\" data-end=\"14\">El art\u00edculo 15 <\/strong>del <strong data-start=\"22\" data-end=\"49\">Reglamento cosm\u00e9tico de la UE<\/strong> establece las normas para el uso de <strong data-start=\"87\" data-end=\"105\" data-is-only-node=\"\">sustancias CMR<\/strong> en cosm\u00e9ticos. Normalmente, <strong data-start=\"130\" data-end=\"172\">las sustancias CMR de las categor\u00edas 1A y 1B<\/strong> est\u00e1n <strong data-start=\"177\" data-end=\"191\">prohibidas<\/strong> en los productos cosm\u00e9ticos (<strong data-start=\"214\" data-end=\"357\">ciertas sustancias CMR de estas categor\u00edas pueden utilizarse si cumplen todas las condiciones establecidas en el art\u00edculo 15(2) de la Regulaci\u00f3n Cosm\u00e9tica<\/strong>). Las <strong data-start=\"360\" data-end=\"392\">sustancias CMR de la categor\u00eda 2<\/strong> pueden emplearse en cosm\u00e9ticos si el <strong data-start=\"425\" data-end=\"475\">Comit\u00e9 Cient\u00edfico de Seguridad de los Consumidores (SCCS)<\/strong> las ha evaluado y considerado seguras.<\/p><p data-start=\"517\" data-end=\"1067\">Para armonizar las normativas y restricciones existentes, la <strong data-start=\"577\" data-end=\"600\">Comisi\u00f3n Europea<\/strong> a\u00f1ade peri\u00f3dicamente todas las nuevas entradas de los <strong data-start=\"642\" data-end=\"650\">ATP <\/strong>al <strong data-start=\"654\" data-end=\"666\">anexo II<\/strong> del Reglamento sobre cosm\u00e9ticos de la UE (<strong data-start=\"699\" data-end=\"732\">lista de sustancias prohibidas<\/strong> en los productos cosm\u00e9ticos). Sin embargo, a petici\u00f3n de la industria cosm\u00e9tica, la <strong data-start=\"808\" data-end=\"831\">Comisi\u00f3n Europea<\/strong> puede permitir su <strong data-start=\"852\" data-end=\"875\">uso de forma excepcional<\/strong> si cumplen <strong data-start=\"889\" data-end=\"914\">requisitos espec\u00edficos<\/strong>. En tal caso, la sustancia se a\u00f1adir\u00e1 al <strong data-start=\"961\" data-end=\"974\">anexo III<\/strong> del <strong data-start=\"982\" data-end=\"1009\">Reglamento cosm\u00e9tico de la UE <\/strong>(<strong data-start=\"1011\" data-end=\"1044\">lista de sustancias restringidas<\/strong> en productos cosm\u00e9ticos).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bd517bf elementor-widget elementor-widget-heading\" data-id=\"bd517bf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Omnibus Act VII: Fecha de aplicaci\u00f3n y alcance<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fa0c907 elementor-widget elementor-widget-text-editor\" data-id=\"fa0c907\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p data-start=\"1227\" data-end=\"1316\">La Omnibus Act VII actualiza el <strong data-start=\"1251\" data-end=\"1263\">Anexo II<\/strong>, incorporando varias sustancias CMR de nueva clasificaci\u00f3n.<\/p><ul data-start=\"1317\" data-end=\"1633\"><li data-start=\"1317\" data-end=\"1363\"><p data-start=\"1319\" data-end=\"1363\"><strong data-start=\"1319\" data-end=\"1339\">Fecha de aplicaci\u00f3n<\/strong>: <strong data-start=\"1341\" data-end=\"1361\">1 de septiembre de 2025<\/strong><\/p><\/li><li data-start=\"1364\" data-end=\"1447\"><p data-start=\"1366\" data-end=\"1447\"><strong data-start=\"1366\" data-end=\"1375\">\u00c1mbito de aplicaci\u00f3n<\/strong>: los productos comercializados en la UE deben cumplir a m\u00e1s tardar en la fecha de aplicaci\u00f3n<\/p><\/li><li data-start=\"1448\" data-end=\"1633\"><p data-start=\"1450\" data-end=\"1633\"><strong data-start=\"1450\" data-end=\"1469\">Sin periodo de venta de existencias<\/strong>: en la pr\u00e1ctica <strong data-start=\"1480\" data-end=\"1497\">no existe diferencia<\/strong> entre \u201cintroducir en el mercado\u201d y \u201cponer a disposici\u00f3n\u201d, por lo que el stock no conforme no podr\u00e1 venderse despu\u00e9s de la fecha de aplicaci\u00f3n.<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0971d96 elementor-widget elementor-widget-heading\" data-id=\"0971d96\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Sustancias CMR prohibidas en virtud de la Omnibus Act VII<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5bcec88 elementor-widget__width-initial elementor-widget-mobile__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"5bcec88\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tLas siguientes sustancias se a\u00f1adir\u00e1n al anexo II, la lista de sustancias prohibidas para su uso en productos cosm\u00e9ticos, no permiti\u00e9ndose su uso a partir del <strong>1 de<\/strong> <strong>septiembre de 2025<\/strong>:\n<div class=\"_tableContainer_sk2ct_1\">\n<div class=\"_tableWrapper_sk2ct_13 group flex w-fit flex-col-reverse\" tabindex=\"-1\">\n<table class=\"w-fit min-w-(--thread-content-width)\" data-start=\"231\" data-end=\"2315\">\n<thead data-start=\"231\" data-end=\"264\">\n<tr data-start=\"231\" data-end=\"264\">\n<th data-start=\"231\" data-end=\"264\" data-col-size=\"xl\">\n<h5><strong data-start=\"233\" data-end=\"262\">Lista de ingredientes prohibidos<\/strong><\/h5>\n<\/th>\n<\/tr>\n<\/thead>\n<tbody data-start=\"300\" data-end=\"2315\">\n<tr data-start=\"300\" data-end=\"400\">\n<td data-start=\"300\" data-end=\"400\" data-col-size=\"xl\">diphenyl(2,4,6-trimethylbenzoyl)phosphine oxide (INCI: Trimethylbenzoyl Diphenylphosphine Oxide)<\/td>\n<\/tr>\n<tr data-start=\"401\" data-end=\"476\">\n<td data-start=\"401\" data-end=\"476\" data-col-size=\"xl\">2,2&#8242;,6,6&#8242;-tetrabromo-4,4&#8242;-isopropilidendifenol; (CE) n\u00ba 1223\/2009<\/strong> para incluir estas sustancias, <strong data-start=\"290\" data-end=\"391\">ahora prohibidas en el uso en productos cosm\u00e9ticos, ya que est\u00e1n clasificadas como sustancias CMR<\/strong>.<\/p><p data-start=\"396\" data-end=\"748\">Las <strong data-start=\"400\" data-end=\"423\">sustancias qu\u00edmicas<\/strong>, para ser utilizadas en productos cosm\u00e9ticos en la UE, <strong data-start=\"479\" data-end=\"513\">deben cumplir las normas REACH<\/strong> (Registro, Evaluaci\u00f3n, Autorizaci\u00f3n y Restricci\u00f3n de Sustancias Qu\u00edmicas). Se trata de un <strong data-start=\"604\" data-end=\"688\">Reglamento europeo cuyo objetivo es proteger la salud humana y el medio ambiente<\/strong> frente a los riesgos que plantean los productos qu\u00edmicos.<\/p><p data-start=\"750\" data-end=\"1104\">Adem\u00e1s, las sustancias utilizadas en productos cosm\u00e9ticos <strong data-start=\"808\" data-end=\"877\">tambi\u00e9n deben cumplir el Reglamento de Productos Cosm\u00e9ticos (CPR)<\/strong>, que se aplica a <strong data-start=\"895\" data-end=\"940\">todos los cosm\u00e9ticos del mercado de la UE<\/strong>.
