New US Regulation on Nail Products Containing Methyl Methacrylate

20th November 2024 – In a significant regulatory update, California’s Department of Toxic Substances Control (DTSC) has proposed amendments to the California Code of Regulations, targeting nail products containing methyl methacrylate (MMA).

Methyl Methacrylate in Nail Products

Methyl methacrylate, commonly used in nail coatings and artificial nails, is under scrutiny for its health risks when misused. The DTSC’s proposal aims to mitigate these risks by classifying MMA-containing products as a Priority Product under the Safer Consumer Products (SCP) framework.

Proposed Regulatory Changes for Methyl Methacrylate

The amendment will require nail product manufacturers, importers, and distributors to adhere to stricter safety and quality standards. The new classification covers any nail product that includes Methyl Methacrylate as an added ingredient, a residual, or a contaminant, enforcing a proactive approach to consumer safety.

California Priority Products

The initiative is part of California’s efforts to prevent deceptive practices and protect human health. It is aligned with the broader objectives of the SCP regulations established in October 2013. The state ensures that all marketed products meet the highest safety benchmarks by setting rigorous compliance standards.

Participate in the Regulatory Process

The DTSC has opened a comment period until the 16th of December 2024. This period allows stakeholders to submit feedback and ensure their concerns are considered in the final regulatory text. Industry participants are urged to review the proposed changes meticulously and prepare for the necessary adjustments.
