Canada Responsible Person

To sell cosmetics in Canada, appointing a Canada Responsible Person is a legal requirement under Canada Cosmetics Regulation. Foreign cosmetic brands must ensure they comply with Canadian cosmetic laws by designating a local entity with a valid Canadian address.

At Cosmeservice, we act as your trusted Canadian Responsible Person, supporting product notifications, ingredient compliance, and labelling review to ensure full alignment with Health Canada’s requirements.

What is the Responsible Person for Canada?

To market cosmetics in Canada, you must designate a Responsible Person with a physical presence in the country. This is not just a recommendation, but a legal obligation under the Food and Drugs Act and the Cosmetics Regulations enforced by Health Canada.

Following the amendment SOR/2024-63, which came into effect on October 9, 2024, foreign brands can now officially appoint a Canadian-based entity to act on their behalf. This entity is recognized as the manufacturer and becomes the regulatory point of contact within Canada.

What is the role of the Responsible Person?

The Responsible Person is your official link to Health Canada. They are accountable for ensuring that your cosmetic products meet national safety, labelling, and notification requirements. Their responsibilities include submitting product data through the Cosmetic Notification Form (CNF), keeping regulatory documentation up to date, and managing any communication with authorities or consumers related to safety or non-compliance.
